By accessing and using Itemwell, you accept and agree to be bound by the terms and provisions of this agreement. These Terms of Service govern your use of the Itemwell platform and services.
Description of Service
Itemwell is a peer-to-peer marketplace that allows users to list, discover, and rent items from other users in their local community. We facilitate connections between item owners and renters but do not own, sell, or rent any items ourselves.
Additional Legal Terms
Analytics and diagnostic tools may be used to maintain and improve the service. These are subject to your consent where required and configured for privacy-by-default.
User-generated content must comply with our community guidelines; we may remove content that violates law or policy. You remain responsible for your interactions and items.
To the extent permitted by law, we disclaim warranties for uninterrupted service. Nothing here limits liability for gross negligence, willful misconduct, or other non-excludable obligations under applicable law.
User Accounts
- You must be at least 18 years old to use our service
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account
- You may only maintain one account per person
- We reserve the right to suspend or terminate accounts that violate our terms
User Conduct
Users agree to use the platform responsibly and in accordance with all applicable laws. Prohibited activities include:
- Listing illegal items or items that violate our community guidelines
- Engaging in fraudulent or deceptive practices
- Harassing, threatening, or abusing other users
- Interfering with the proper working of the platform
- Using automated scripts to collect information or otherwise interact with the platform
- Impersonating another person or entity
Item Listings and Transactions
User Responsibility
Owners are responsible for providing accurate and complete information in their listings. Renters are responsible for returning items in the condition they were received.
Transactions
Users are solely responsible for their transactions. Itemwell is not a party to any rental agreement between users.
User Disputes
Disputes between users must be resolved directly between them. Itemwell may, but is not obligated to, mediate disputes.
Fees and Payments
Itemwell may charge fees for certain services. Any applicable fees will be clearly communicated before you incur the charge.
Intellectual Property
User Content
You grant Itemwell a non-exclusive, worldwide, royalty-free license to use, reproduce, and display the content you post on the platform (such as item photos and descriptions) for the purpose of operating and promoting the service.
Platform Rights
The Itemwell platform, including its logos, design, and source code, is the exclusive property of Itemwell and is protected by copyright and trademark laws.
Disclaimers
The service is provided "as is".
The service is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied.
Limitation of Liability
To the fullest extent permitted by law, Itemwell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Indemnification
You agree to indemnify and hold harmless Itemwell and its employees from any claim or demand arising out of your use of the platform or violation of these terms.
Termination
We reserve the right to suspend or terminate your account and access to the platform at our discretion, without notice, for any conduct that we believe violates these terms.
Governing Law
These terms shall be governed and construed in accordance with the laws of the jurisdiction in which Itemwell operates, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of changes by posting the updated terms on the site. Your continued use of the platform constitutes acceptance of the new terms.
